Your use of our Website and the NapiApp does not constitute any right or license for you to use such service marks/trademarks, without the prior written permission of the corresponding service mark/trademark owner. Our Website and the NapiApp are also protected under international copyright laws. The copying, redistribution, use or publication by you of any portion of our Website and the NapiApp is strictly prohibited. Your use of our Website and the NapiApp does not grant you ownership rights of any kind in our Website or the NapiApp.

Definition

Intellectual Property Rights for the purposes of this policy means all intellectual property rights including, but not limited to, patents, trade secrets, trademarks, service marks, trade names, copyrights and other rights in works of authorship (including rights in computer software), moral and artists' rights, design rights, trade or business names, domain names, know-how, database rights and semi-conductor topography rights, whether any of the foregoing are registered or unregistered and all rights or forms of protection of a similar nature in any country.

Intellectual Property Policy

The Customer acknowledges that Napi Digital Ltd is the owner of the intellectual property rights in the Licensed Software (“Software”) that comprises the NapiApp and shall not dispute or challenge the rights of Napi Digital Ltd to the intellectual property rights in the Licensed Software. Furthermore, Napi Digital Ltd warrants that it is the owner of the intellectual property rights in the Software, and the use of the NapiApp and its associated Software does not constitute in any way the Customer acquiring any rights of ownership in the Software.

The Customer shall not do, or omit to do, or permit to be done, any act which will or may weaken, damage or be detrimental to the intellectual property rights in the Software or which may invalidate or jeopardize the intellectual property rights in the Software.

The Customer shall promptly provide Napi Digital Ltd with copies of all communications with any regulatory, industry or other authority relating to the intellectual property rights in the Software in the event that Napi Digital Ltd should request such material from the Customer.

Copyright Policy

We respect the Intellectual Property Rights of others. It is our policy to respond to any claim that Content posted on our Website or within the NapiApp infringes the copyright or other Intellectual Property rights ("Infringement") of any person or company. If you are a copyright owner or authorized on behalf of one, and you believe that the copyrighted work has been copied in a way that constitutes copyright infringement that is taking place through our Website or the NapiApp, you must submit your notice in writing with the header notice of "Copyright Infringement" to the email address [email protected] and include in your notice a detailed description of the alleged Infringement. You may be held accountable for damages (including costs and attorneys' fees) for misrepresenting that any Content infringes your or someone else’s copyright.
